One has to wonder whether the immediacy of purchasing via eBay and PayPal, is not preferable to chequebooks and snail mail from the MOC?

Is this supplier the same one that the MOC use to provide the badges?

Should they not be prosecuted by the MOC for clearly profiting from the copyright MOC logo?

A certain amount of irony here!

Or it’s simply a second hand or unused item up for sale...

Seems unlikely as it would appear there were 3 for sale. Description is brand new un opened.

It must depend on the source and copyright if they are from China the only course is to involve trading standards if they are counterfeit and the vendor is UK based

It might be quite complicated and is it worth it over 3 badges which may have come from the same source as Genuine Marlin ones Who Knows ?

Complicated indeed. Someone must make the badges, inevitably someone with skills not within the MOC membership.

I raised the issue because a Club Member was told not to use the Club Logo for a charity event despite it being exclusively a Marlin Owners event. Odd indeed then that the Club Logo can be sold at a profit by, presumably a ‘non member’.

I only ask questions, having been accused of breaching MOC copyright.
It seems there is one rule for MOC members and another for the general public, or is there a difference between a physical item sold for profit, or a virtual item shared under ‘fair use’ terms, not for profit?

              All I seek is clarity!

These badges are being offered by the manufacturer.

                  My point entirely.
Are they not bound by a licencing agreement, or can they do exactly what they want, free from constraints applied to MOC club members?
it seems a little absurd that they can profit financially by association.
                  Annswers please!

I think Steve it depends who owns the rights to the artwork and in this instance it might be the manufacturer
Danny says its the manufacturer offering the badges
As they offer many different products on E Bay i think its an E Bay trader who has bought them in to sell along with their other products
I dont really think the sale of a few badges warrants an issue unless MOC owns the copyright and the rights to the artwork and exclusive use of the logo
